BCCT EVENING PANEL DISCUSSION: LitigationArbitration Mediation 

Many would have thought that Thai cultural attitudes of compromise and the avoidance of conflict, would lead to the popularity of arbitration as a method of dispute resolution rather than a confrontational dispute in a public court room.

However, judicial statistics show that litigation is far more popular in Thailand than arbitration. Why is this the case?

Stephen Frost, Chair of the BCCT Legal and Tax Group and Senior Consultant of Wissen & Co, will give a short powerpoint presentation on the plusses and minuses of litigation versus arbitration, and how those involved in disputes should analyse which method of dispute resolution is preferable.

He will then join our other three distinguished experts for a panel discussion 

The panel will also consider the growing popularity of mediation, as a preliminary to court proceedings, or private mediation by a skilled and trained private mediator. Can mediation be a less confrontational method of dispute resolution, once again, leading to a resolution of the dispute which is satisfying to the parties involved?
